Terms of Service

1. Eligibility and minimum age

You must be at least 13 years old and meet any higher minimum age required where you live. If you are not legally able to agree to these Terms yourself, a parent or legal guardian must approve your use. SpotRank may restrict access where required by law or App Store rules.

2. Accounts, security, and usernames

Provide accurate registration information, protect your sign-in credentials, and promptly report unauthorized access. You are responsible for activity through your account.

Usernames must be unique, must not impersonate another person or organization, and may be changed or reclaimed when they violate these Terms, infringe rights, or create security or moderation risk.

3. Your content and photos

You retain ownership of content you submit. You are responsible for every photo, caption, comment, rating, and other submission. Upload only content you created or are authorized to use. Stolen, scraped, or unauthorized photos are prohibited.

You grant SpotRank a non-exclusive, worldwide, royalty-free license to host, process, reproduce, resize, display, and distribute submitted content inside SpotRank as needed to operate, secure, moderate, and improve the service. This permission ends when the content is deleted, except for reasonable backups, legal obligations, and content already shared or retained for safety and enforcement.

4. Prohibited content and conduct

Do not post or engage in harassment, bullying, threats, hate speech, sexual or explicit content, graphic violence, scams, impersonation, spam, illegal content, malicious privacy invasion, or content intended to harm another person. Do not target, intimidate, stalk, or abuse other users; manipulate rankings; automate abusive activity; evade enforcement; interfere with SpotRank; or attempt unauthorized access to accounts, systems, or data.

5. Car spotting and location safety

Never trespass, drive dangerously, obstruct traffic, confront vehicle owners, reveal a private residence maliciously, or take any unsafe or illegal action to create a spot. Respect people, property, license-plate privacy, venue rules, and local laws.

Location and verification features are aids only. They do not make an activity safe, authorized, or lawful.

6. Challenges and events

Challenge and event participation may require in-app capture, time, location, vehicle, eligibility, or event-specific verification. Entries may be rejected or removed when they cannot be verified, violate rules, are submitted outside an active period, or create safety or integrity concerns. Events may change or be cancelled.

7. Ranks, scores, rarity, and leaderboards

XP, scores, rarity results, ranks, rewards, and leaderboard positions are service features, not property or money. SpotRank may correct errors, remove fraudulent activity, recalculate results, adjust scoring rules prospectively, and resolve ties or integrity issues. Community votes are opinions and do not guarantee a vehicle’s identity, value, rarity, or authenticity.

8. Moderation and enforcement

Users may report posts, comments, replies, profiles, and accounts and may block other users. SpotRank may review content and account activity, remove content, limit features, preserve relevant evidence, suspend accounts, or permanently ban users. Serious violations may be reported to appropriate authorities when legally required. Repeated or severe violations may result in immediate termination without warning.

9. Account deletion and termination

You may request account deletion from Settings. Deletion is intended to remove the account and associated content subject to technical processing time, backups, fraud prevention, moderation records, legal duties, and content that must reasonably be retained. SpotRank may suspend or terminate access for violations, risk, legal requirements, or discontinuation of the service.

10. Intellectual-property complaints

If you believe content infringes your copyright or other intellectual-property rights, contact support with identification of the protected work and challenged content, your contact information, a good-faith statement, and evidence that you are authorized to act. SpotRank may remove challenged material and take action against repeat infringers.

11. Third-party services

SpotRank may rely on services provided by Apple, Google, Supabase, Maps providers, and other infrastructure vendors. Their own terms and privacy policies may apply to features they operate. SpotRank is not responsible for third-party services outside its control.

12. Availability and changes

SpotRank may add, change, suspend, or discontinue features and may perform maintenance without guaranteeing uninterrupted availability. Content, rankings, events, and stored data can be affected by outages, device limitations, network conditions, or third-party services.

13. Disclaimers

To the extent permitted by law, SpotRank is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, non-infringement, vehicle identification, event availability, or user conduct. Nothing in these Terms excludes rights that cannot legally be excluded.

14. Limitation of liability

To the extent permitted by law, SpotRank and its owner will not be liable for indirect, incidental, special, consequential, or punitive damages, lost data, lost profits, personal disputes, unsafe spotting activity, or third-party conduct arising from use of the service. Any limitation applies only to the maximum extent permitted by applicable law.

15. Changes to these Terms

These Terms may be updated as SpotRank, applicable law, or service providers change. Material updates will receive a revised date and appropriate notice. Continued use after updated Terms take effect means you accept them where permitted by law.
